Terms of Service

This is a contract. We wrote it to be read, not skimmed. It covers what Presume does, what you agree to when you use it, what happens with your money, what happens with your data, and what happens if something goes wrong. If a clause matters to your business, read it twice. If something is unclear, email legal@getpresume.com before you sign up.

These Terms of Service ("Terms") form a binding agreement between you ("you," "your," or "Customer") and Amaar Chughtai, a sole proprietor operating Presume ("Presume," "we," "us," or "our") based in California, United States, doing business at getpresume.com. By creating an account, clicking "I agree," or using the service in any form, you accept these Terms. If you do not agree, do not use the service.

1. The service

Presume is a business-to-business software-as-a-service platform that simulates how synthetic users ("personas") might respond to changes in your product. You provide product descriptions, feature copy, pricing, and persona definitions. Our system routes that input through one or more large language model providers, generates synthetic responses, aggregates them into sentiment distributions, churn estimates, and qualitative quotes, and returns the result to you.

Outputs are probabilistic forecasts, not factual claims, market research, expert opinions, or guarantees of real-world user behavior. See Section 11.

2. Eligibility and acceptance

You must be at least 18 years old and legally capable of entering into a contract in your jurisdiction. Presume is a B2B service intended for businesses, product teams, and individual professionals — not for consumer or minor use. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to both you and that organization.

You agree to comply with all laws applicable to your use of the service, including U.S. export controls, sanctions regimes, and the data-protection laws of your own jurisdiction.

3. Accounts and credentials

You are responsible for keeping your login credentials secure. Do not share them. Do not let anyone outside your team use your account. You are responsible for all activity that occurs under your account, whether or not you authorized it, until you notify us of suspected unauthorized access at hi@getpresume.com.

If you invite teammates, you remain the account owner and remain responsible for their use of the service under your account.

4. Subscriptions, credits, and billing

Presume offers three plans: Spark ($49/month, includes 500 credits), Forge ($199/month, includes 2,500 credits), and Atlas (custom enterprise pricing — contact us). Each simulation consumes credits based on its size and the underlying model cost. You may also purchase one-time credit top-ups at the prices listed in your account.

Subscriptions auto-renew at the end of each billing period (one month, unless otherwise stated) at the then-current price until you cancel. We bill in advance through Stripe, our payment processor. All prices are in U.S. dollars and exclusive of taxes; applicable sales tax, VAT, or GST is added at checkout where required.

You may cancel at any time from Settings. Cancellation takes effect at the end of the current billing period — you keep access through the period you have already paid for. We do not pro-rate refunds for partial months.

Refund policy. Subscription fees are non-refundable once charged, except where required by law. Credits — both subscription-included and top-ups — are non-refundable once they have been consumed by a simulation. Unused subscription credits expire at the end of each billing period and do not roll over. Unused top-up credits remain valid for twelve (12) months from purchase. If a technical failure on our end consumes credits without delivering a usable result, contact hi@getpresume.com and we will re-credit your account at our discretion.

We may change pricing on at least thirty (30) days' notice. Continued use after a pricing change takes effect constitutes acceptance of the new pricing. Failed payments may result in suspension after a reasonable grace period.

5. Acceptable use

You agree not to:

  • Use the service to generate, store, or distribute content that is illegal, defamatory, harassing, sexually explicit involving minors, or that infringes on the rights of any third party;
  • Upload personal data of identified or identifiable individuals (customer lists, employee data, medical records, etc.) without a lawful basis and the necessary consents;
  • Use the service to scrape, replicate, benchmark, or build a competing product, including by feeding our outputs into another model or service;
  • Attempt to jailbreak, prompt-inject, or otherwise circumvent the safety guardrails of the underlying language models;
  • Probe, scan, or test the vulnerability of any Presume system, or breach or circumvent our authentication or security measures;
  • Interfere with or disrupt the service, the servers or networks supporting it, or the experience of other customers;
  • Reverse-engineer, decompile, or attempt to extract the source code or model weights of any component of the service, except to the extent expressly permitted by applicable law;
  • Resell, sublicense, or provide the service as a service to third parties without our written permission;
  • Use the service in any way that violates U.S. export-control or sanctions laws.

We may suspend or terminate accounts that violate this section, with or without notice depending on the severity of the violation.

6. Intellectual property — your content

You retain all rights to the content you upload to Presume: product descriptions, feature specifications, pricing data, persona definitions, prompts, and any other inputs (collectively, "Customer Content"). You grant Presume a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display Customer Content solely to operate and provide the service to you, and to route it through the third-party language-model providers listed in our Privacy Policy.

You represent and warrant that you have all rights necessary to upload your Customer Content and to grant the license above, and that your Customer Content does not violate any third-party rights or applicable law.

7. Intellectual property — the platform

Presume, including its software, design, brand, dashboards, aggregation logic, synthesis pipeline, persona templates, and all related intellectual property, is owned by Amaar Chughtai and is protected by U.S. and international intellectual-property law. Nothing in these Terms transfers ownership of the platform to you.

Simulation outputs ("Outputs") are generated by large-language-model providers based on your inputs and our orchestration. Subject to your compliance with these Terms, we grant you a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, adapt, and distribute the Outputs for your internal business purposes and for your external commercial purposes (including using them in pitches, reports, marketing, and product decisions). The underlying synthesis methodology, templates, and platform components remain ours.

Because Outputs are generated by AI, multiple customers may receive similar or identical Outputs from similar inputs. We make no representation that Outputs are unique to you.

8. Feedback

If you send us suggestions, ideas, or feedback about the service, we may use them freely, without obligation or compensation to you. We will not publicly attribute feedback to you without your permission.

9. Third-party services

The service depends on third-party providers, including Supabase, Stripe, Vercel, and OpenRouter (which routes requests to Anthropic, OpenAI, DeepSeek, and other model providers). Your use of the service is subject to the relevant terms of those providers as applied to the data flows we describe. We are not responsible for outages, errors, or changes in those providers beyond our reasonable control.

10. Privacy and data protection

Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for ensuring that you have a lawful basis to upload any personal data about third parties and for fulfilling any data-subject-rights requests that pertain to data you control.

11. AI-specific disclaimers

Presume uses large language models to generate synthetic user responses. You acknowledge and accept the following:

  • Outputs are predictive estimates based on statistical patterns, not measurements of real user behavior. Real users may respond very differently.
  • Outputs are non-deterministic: the same input may produce different outputs across runs.
  • Models can hallucinate. Quotes, sentiment scores, churn predictions, and other artifacts may be inaccurate, biased, or fabricated despite appearing authoritative.
  • Nothing produced by Presume constitutes professional advice — not legal, medical, financial, investment, tax, psychological, or any other regulated advice. Do not rely on Outputs as a substitute for qualified professional judgment.
  • You are solely responsible for any business, product, pricing, marketing, or strategic decision you make based on Outputs.
  • Models may reflect biases present in their training data. We do not warrant that Outputs are free from bias.

12. Warranty disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRESUME DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT OUTPUTS WILL BE ACCURATE, RELIABLE, OR FIT FOR ANY PARTICULAR PURPOSE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PRESUME BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

PRESUME'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO PRESUME IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages; in those jurisdictions, the limitations above apply to the maximum extent permitted by law.

14. Indemnification

By you. You agree to defend, indemnify, and hold Presume and Amaar Chughtai harmless from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (i) your Customer Content, (ii) your use of the service in violation of these Terms or applicable law, (iii) your violation of any third-party right, or (iv) decisions you make based on Outputs.

By Presume. We will defend you against any third-party claim that the service itself, as provided by us and used by you in accordance with these Terms, infringes that third party's U.S. intellectual-property rights, and will pay amounts finally awarded by a court of competent jurisdiction or agreed in settlement, subject to the liability cap in Section 13. This is our sole obligation and your sole remedy for IP infringement claims.

Each party will promptly notify the other of any claim, give the indemnifying party sole control of the defense, and cooperate reasonably.

15. Term and termination

These Terms remain in effect for as long as you have an account with Presume. You may terminate at any time by canceling your subscription and deleting your account from Settings. We may suspend or terminate your access at any time, with or without notice, for (a) material breach of these Terms, (b) non-payment, (c) activity that creates legal, security, or operational risk to Presume or other customers, or (d) extended inactivity.

Upon termination, your right to access the service ends immediately. We will delete your data on the schedule described in our Privacy Policy. Sections that by their nature should survive termination — including IP ownership, disclaimers, liability limits, indemnification, governing law, and dispute resolution — will survive.

16. Changes to these Terms

We may update these Terms from time to time. For material changes, we will provide at least thirty (30) days' notice by email to the address on your account and by updating the "Last updated" date at the top of this page. Continued use of the service after the effective date of the change constitutes acceptance. If you do not agree with the change, you must stop using the service and may cancel your subscription before the effective date.

17. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

18. Dispute resolution and arbitration

Informal resolution first. Before filing any formal claim, you agree to contact us at legal@getpresume.com and attempt in good faith to resolve the dispute for at least sixty (60) days.

Binding arbitration. If informal resolution fails, you and Presume agree that any dispute, claim, or controversy arising out of or relating to these Terms or the service will be resolved by binding, individual arbitration administered by JAMS under its Streamlined Arbitration Rules then in effect, conducted in San Francisco, California (or remotely, if both parties agree), before a single arbitrator. The arbitrator's decision will be final and may be entered as a judgment in any court of competent jurisdiction.

Class action waiver. You and Presume agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Exceptions. Either party may bring an individual action in small-claims court, and either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information.

Opt-out. You may opt out of this arbitration agreement by emailing legal@getpresume.com with the subject line "Arbitration Opt-Out" within thirty (30) days of first accepting these Terms.

19. General

Entire agreement. These Terms, together with the Privacy Policy and any order form, are the entire agreement between you and Presume about the service and supersede all prior or contemporaneous communications.

Severability. If any provision is held unenforceable, the rest of these Terms remains in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.

Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to a successor in connection with a merger, acquisition, reorganization, or sale of assets (including a future conversion of the sole proprietorship to a corporate entity).

Force majeure. Neither party is liable for failure to perform due to causes beyond its reasonable control, including acts of God, war, terrorism, civil unrest, internet or hosting-provider outages, or government action.

Relationship. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Presume.
